This privacy statement governs the processing of your personal data when you use the website www.1wire.be and our 1wire application, which is used via the URL app.1wire.be. Capivara Capital BV (0636.978.709), established at James Ensorlaan 13, 2840 Rumst, Belgium, is the data controller.
We make every effort to ensure this data protection and always to act in accordance with data protection legislation when we process personal data. "Data protection legislation" means: i) the General Data Protection Regulation (better known as the "GDPR"), ii) the other European regulations containing provisions on data protection and privacy, and iii) the applicable national legislation on data protection and privacy in the member states.

Capivara Capital develops an application that allows users to draw electrical diagrams. In that context Capivara Capital comes into contact with personal data and will process it.
Capivara Capital reserves the right to amend this privacy statement if necessary. We therefore ask you to read this privacy statement regularly to stay informed of any changes. Substantial changes will always be communicated and will be immediately visible on this page.
In accordance with current regulations, we understand personal data to mean any information relating to an identified or identifiable natural person ("the data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
We define the processing of personal data as any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction of data.
Capivara Capital may process the following categories of personal data:
Identification data (such as surname, first name, phone or mobile number, email address, IP address) and address data of both the user and their clients.
Users and the user's clients (who have electrical diagrams drawn up).

We collect personal data for the use of the website and for the provision of certain services. In addition, our web server automatically recognises your IP address every time you visit our website.
This personal data allows us to respond to your request, to continuously improve the website and the services/products offered to you, and to adapt them to your needs. In this respect we reserve the right to use your information for market and satisfaction surveys or for the development of services/products.
When you register, the software records the details you entered in our secure database. This data is used to give you access to our software at a later time. Passwords are always stored encrypted. All data you enter while using our software is available only to you. Capivara Capital BV will never modify, delete or sell this data to third parties unless the customer has expressly consented to this.
If you no longer wish to use our software, you can let us know via our contact form or by email. We will then permanently delete your data.
The personal data we collect is used to answer your questions appropriately and accurately. This information is recorded in our customer system so that we can offer you an even better service in the future.
To handle your requests for information fully, we keep your personal data for this activity for as long as you are our customer. If you are not a customer of Capivara Capital, we will delete this data after your question has been answered, or keep it to stay in touch with you (for example if you showed interest in one of our products).
We consider it important to have a good relationship and communication with all our customers. That's why we will contact you to keep you informed of relevant offers/promotions and of innovations and news you may find interesting. We also use your email address to inform you about developments in our software and to ask for your feedback.
For the processing of personal data under this activity, Capivara Capital relies on its legitimate interest. If you receive these communications from us, you can indicate at any time that you no longer wish to receive them.
Capivara Capital collects invoicing and administrative data to meet its administrative obligations, such as charging for the services provided to the customer or keeping our legally required accounts.
Processing takes place for the duration of the agreement plus three months, unless Capivara Capital is legally obliged to keep the data longer.
Capivara Capital does not sell your data. Capivara Capital will refrain from disclosing or passing on your personal data to third parties without your prior consent, except in the following cases:
We use Google Ads to measure whether Google ads lead to registrations and relevant use of our services, and to report on and optimise the performance of those ads. The legal basis for this processing is your consent.
Via the Google tag we may pass on to Google the URL of the page visited, your IP address, technical data about your browser and device, the referring URL, your consent status and the Google click identifier (gclid) or an indication that a page contains such a click identifier. Depending on your consent choice, the Google tag may place or read cookies, or send cookieless measurement signals.
Capivara Capital and Google each act as separate controllers for this processing. For personal data of persons in the European Economic Area, Google Ireland Limited is the responsible Google entity. For transfers to countries outside the EEA, Google uses the transfer mechanisms described in its terms. We keep the Google click identifier and our record of sent conversion events in accordance with the period in article 3.4. Google keeps the data received in accordance with its own applicable terms and legal obligations. We use the OpenAI Ads Measurement Pixel and the OpenAI Conversions API to measure whether ads in ChatGPT lead to registrations and relevant use of our services, and to report on and optimise the performance of those ads. The legal basis for this processing is your consent.
Via the pixel we may pass on to OpenAI the OpenAI click identifier (oppref), a browser identifier, the source URL and page visited, technical data about your browser and device, your IP address and diagnostic data. When you register, we may additionally pass on a registration event, the time and the source URL of the registration via the Conversions API. We do not pass on any content from your ChatGPT conversations to OpenAI for this purpose.
Capivara Capital and OpenAI each act as separate controllers for most of this processing. Data of persons in the European Economic Area is processed by OpenAI Ireland Limited. For any further transfers to countries without an adequate level of protection, OpenAI uses a valid transfer mechanism. We keep the OpenAI click identifier and our record of sent conversion events in accordance with the period in article 3.4. OpenAI keeps the data received in accordance with its own applicable terms and legal obligations. Capivara Capital will do what is necessary to process your personal data within the European Economic Area wherever possible. If personal data is nevertheless transferred to countries or organisations outside the EEA, an appropriate safeguard will always be provided.
The 1wire software is hosted on servers rented from Amazon Web Services (aws.amazon.com). These servers are physically located in Ireland. Data is stored on fixed disks that are also rented from Amazon Web Services and physically located in Ireland. Transactional emails are sent via Amazon Web Services.
Communication between the end user's computer and Capivara Capital's servers always takes place over an encrypted connection.
We use appropriate technologies to prevent data breaches. We have a procedure to test and evaluate the technical measures at regular intervals.
In the event of a data breach, we report it to the competent supervisory authority within 72 hours. In the event of an incident, we will respond appropriately by closing the leak, recalling all data from before the incident and showing our customers what steps we have taken to prevent similar incidents.
Capivara Capital provides you without undue delay and in any event within one month of receipt of the request with information on the action taken on the request. Every request must be made via contact@1draad.be.
You have the right to obtain confirmation as to whether or not your personal data is being processed. If so, you can obtain access to that data. You can also get a copy of it, which we provide on paper or digitally.
You have the right to ask for your personal data to be corrected if it is inaccurate or incomplete.
You may ask for processing to be restricted when, for example, the accuracy of the personal data is contested.
You have the right to ask for your personal data to be deleted if, for example, it is no longer needed for the purposes for which it was collected or if you withdraw your consent to the processing. You can ask at any time for all your data – including data of third parties such as customer data you entered in our software – to be deleted by sending a simple email to contact@1draad.be.
You have the right to receive your personal data in a structured, commonly used and machine-readable format and to transfer that data to another controller.
If you feel that your personal data is not being processed correctly, you can object to this processing, such as processing for direct marketing purposes, or other processing that is not necessary in the context of the professional relationship. You also have the right not to be subject to a decision based solely on automated processing.
